The employer must ensure: Walking-working surfaces are inspected, regularly and as necessary, and maintained in a safe condition a) On or about March 21, 2025, the employer failed to inspect and maintain a walking-working surface in a safe condition at the warehouse loading dock area. Specifically, a faulty dock plate was not repaired and remained in use. As a result, an employee sustained finger injuries when their fingers were caught in the lip of the dock plate while attempting to position it.

29 CFR 1910.22(d)(2): Walking-working surfaces. General requirements. Inspections, maintenance and repair. The employer must ensure: Hazardous conditions on walking-working surfaces are corrected or repaired before an employee uses the walking-working surface again. If the correction or repair cannot be made immediately, the hazard must be guarded to prevent employees from using the walking-working surface until the hazard is corrected or repaired; a) On or about March 21, 2025, the employer failed to ensure that hazardous conditions on a walking-working surface were corrected or repaired before the surface was used by employees, as required. Specifically, at the warehouse loading dock area, a dock plate with a known defect remained in use and was not repaired or guarded to prevent employee access. This resulted in an employee sustaining an injury to their fingers when they became caught in the lip of the dock plate while attempting to position the dock plate.

The employer must train each employee who uses a dock-board to properly place and secure it to prevent unintentional movement. On or about March 21, 2025, the employer failed to train employees on the proper placement and securement of a dock board to prevent unintentional movement. Specifically, an employee was injured when they stood on the dock plate during placement, resulting in a fall and finger injuries when their fingers became caught in the dock plate.
