OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm workplace to employees in that employees were exposed to crushing hazards from shifting and/or falling loads:  (a) On or about March 27, 2025, the employer did not ensure an employee operating an overhead crane (Crane N-2) was protected from crushing hazards associated with lifting and staging I-beams weighing approximately 1500 lbs. An operator was fatally injured while standing in the fall zone while placing an I-beam adjacent to an already staged beam in the shop area, when the employee was crushed between the two beams.   Among other methods, feasible and acceptable abatement method to correct this hazard can be found in the American Society of Mechanical Engineers, ASME B30.9-2021, Safety Standard for Cableways, Cranes, Derricks, Hoists, Hooks, Jacks, and Slings, Section 9-1.10.2 Cautions to Personnel states:   (a) All portions of the human body shall be kept from between the sling and the load, and from between the sling and the load, and from between the sling and the hook, shackle, or other load-handling device.  (b) Personnel should never stand in line with or next to the leg(s) of a sling that is under tension.  (c) Personnel shall not stand or pass under a suspended load. (d) Personnel shall not ride the sling.  Another feasible and acceptable abatement method to correct this hazard is found in the Rig-Master Model 111 Beam Tongs Instruction Manual section entitled "Safety Information" pg. 6 under Operating Practices, identifies: "Barricade people from swing zones, fall zones, and crush zones."

29 CFR 1910.184(d): Each day before being used, the sling and all fastenings and attachments were not being inspected for damage or defects by a competent person designated by the employer:  (a) On or about March 27, 2025, the employer did not ensure slings, fastenings, and attachments were being inspected for damage or defects by a competent person. Employees operating overhead cranes were exposed to struck-by and crushing hazards while moving I-beams that varied in size and weight with steel chains without identification tags and individual links bearing directly against the shackle or load that were not inspected prior to use for elongation or other defects.
