29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedures, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: On or about March 28, 2025, the employer did not establish an energy control program consisting of energy control procedures, employee training, and periodic inspections. Employees using the following machines to include but not limit to the Enviro-Pak Smokehouse, Daniels AFMG 600 Mixer Grinder and the Cry-O-Vac machine, were not protected from the unexpected energization, startup, or release of stored energy while performing servicing and maintenance activities, such as, but not limited to, clearing jams, cleaning and sanitizing activities. Energy sources include but are not limited to, electrical and pneumatic energy.

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical On or about March 28, 2025, the employer did not ensure that each container used to hold hazardous chemicals had the benefit of a labeling system to identify the product and the associated hazards. Employees are tasked to transfer hazardous chemicals to include but not limited to Da-Clean Ultra, Smokehouse Cleaner, Poly-Strip, Min-Rid and Bleach Concentrate from labeled containers into buckets and/or spray bottles for use. The containers utilized to hold these samples were mislabeled and/or lacked the appropriate hazard communication information.

29 CFR 1910.1200(h)(1):Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. On or about March 19, 2025, the employer did not ensure employees were provided with effective information and training on all hazardous chemicals in their work area to include but not limited to Q-San Sanitizer, Da-Clean A.P.C., Da-Clean Ultra, Smokehouse Cleaner, Poly-Strip, Min-Rid and Bleach Concentrate at the time of their initial assignment and/or whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area.
