29 CFR  1910.1030(c)(1)(i): The employer having employee(s) with occupational exposure did not establish a written Exposure Control Plan, designed to eliminate or minimize employee exposure, describing how the elements specified in 29 CFR 1910.1030(d) through (h) will be met:   a) Facility - On or about 12/20/2024 - the employer did not develop and implement a bloodborne pathogens program for employees exposed to blood and other potential infectious materials while working at Quatela Center for Plastic Surgery.  Employees are exposed to bloodborne pathogens, while cleaning procedure rooms, that can cause illness as a result of the employer's failure to develop a written Exposure Control Plan.  This plan must include an exposure determination for employee occupation exposure and the implementation of standard paragraphs (d) Methods of Compliance, (f) Hepatitis B Vaccination and Post-Exposure Evaluation and Follow-up, (g) Communication of Hazards to Employees, and (h) Recordkeeping.  Employees have occupational exposure as they clean procedure rooms and empty garbage that contains bloody bandages and surgical drains containing blood.  ABATEMENT CERTIFICATION REQUIRED

29 CFR  1910.1030(g)(2)(i):The employer did not train each employee with occupational exposure in accordance with the requirements of this section. Such training must be provided at no cost to the employee and during working hours. The employer did not institute a training program and ensure employee participation in the program upon initial assignment with occupational exposure and annually thereafter.  a) Facility - On or about 12/20/2024, employees with reasonably anticipated exposure to blood and/or other potentially infectious materials (OPIM), while working at Quatela Center for Plastic Surgery, were not provided with the required training.  Employees were exposed to bloodborne pathogens that can cause illness as a result of the employer's failure to provide site specific bloodborne pathogen training initially and then at least annually thereafter. 29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) Facility - On or about 3/28/25 , the employer did not develp and implement their written hazard communication program for employee who work with materials such as, but not limited to Clorox Cleanup (sodium hypochlorite solution and sodium hydroxide), Fabulouso All Purpose Cleaner (containing benzyl benzoate, dihydromyrcenol and 4-tert-butylcyclohexyl acetate), CLR (lactic acid and lauramine oxide) and Diversey Crew Super Blue Mild Acid Bowl Cleaner (containing oxalic acid and dodecylbenzene sulfonic acid).  A written program should include descriptions of how the criteria for:      1.   Labeling and other forms of warning;      2.   Safety Data Sheets, and      3.   Employee information and training will be met.  Additionally, a list of hazardous chemicals known to be present in the workplace must be compiled.  Methods used to inform employees of the hazards associated with non-routine tasks and the informing of contractors of workplace hazard must also be addressed.  The written program must be made available upon request.   ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.1200(h)(1): Employees were not provided information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced into their work area.  a) Facility - On or about 3/28/25, the employer did not develop and implement a written hazard communication program for employee who work with materials such as, but not limited to Clorox Cleanup (sodium hypochlorite solution and sodium hydroxide), Fabulouso All Purpose Cleaner (containing benzyl benzoate, dihydromyrcenol and 4-tert-butylcyclohexyl acetate), CLR (lactic acid and lauramine oxide) and Diversey Crew Super Blue Mild Acid Bowl Cleaner (containing oxalic acid and dodecylbenzene sulfonic acid).  Employees shall be informed of the following:  1) The requirements of this section; 2) Any operations where hazardous chemicals are present; AND 3) The location and availability of the written Hazard Communication Program, list(s) of hazardous chemicals, and Safety Data Sheets.  Employee training shall include at least:  1) Methods and observations that may be used to detect the presence or release of a hazardous chemical in the      work area. 2) The physical and health hazards of the chemicals in the work area. 3) The measures employees can take to protect themselves such as specific procedures, appropriate work practices,     emergency procedures and personal protective equipment to be used. 4) The details of the employers Hazard Communication Program including an explanation of labeling systems, Safety      Data Sheets, and how employees can obtain and use the appropriate hazard information.
