29 CFR  1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:   (a)Rapid Foundation Repair, Inc. at 1124 North 7th Street, Rapid City, SD 57701: On or about and at times prior to March 28, 2025, the employer did not ensure a competent person conducted daily inspections to include both visual and manual evaluation to aid in classifying soil type prior to employees performing work in the excavations. This condition exposed employees to struck-by and cave-in hazards.

29 CFR  1926.1153(d)(2)(i):The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  (a)Rapid Foundation Repair, Inc. at 1124 North 7th Street, Rapid City, SD 57701: On or about and at times prior to March 28, 2025, the employer did not ensure employees were protected from health hazards of occupational exposure to respirable crystalline silica when operating a Bosch Demolition Hammer to remove portions of concrete from residential foundations in that the employer did not implement controls specified in Table 1 or assess employee exposure to respirable crystalline silica. Employees who inhale respirable crystalline silica are at an increased risk of developing serious disease including but not limited to; silicosis, lung cancer, chronic obstructive pulmonary disease and kidney cancer.

This condition exposed employees to struck-by and cave-in hazards.  Rapid Foundation Repair, Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1727989, citation number 1, item number 4 and was affirmed as a final order on 6/10/2024, with respect to a workplace located at 514 Washington Street, Lead, SD 57754.

This condition exposed employees to struck-by and cave-in hazards.   Rapid Foundation Repair, Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1727989, citation number 1, item number 3a and was affirmed as a final order on 6/10/2024, with respect to a workplace located at 514 Washington Street, Lead, SD 57754.
