29 CFR  1910.1200(e)(1): The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met:   New York Dak Kal BI Corp.  149-06 Northern Blvd. STE 1C, Queens, NY.   a) Employees engaged in dishwashing activities were exposed to hazardous corrosive chemicals such as, but not limited to, Pink Suds (containing sodium hydroxide 20-30%) and So-Kleen Oven (mixture of sodium hydroxide and methanol).  The employer did not develop and implement a Hazard Communication Program; on or about 03/28/2025.  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  New York Dak Kal BI Corp.  149-06 Northern Blvd. STE 1C, Queens, NY.   a) Employees engaged in dishwashing activities were exposed to hazardous corrosive chemicals such as, but not limited to, Pink Suds (containing sodium hydroxide 20-30%) and So-Kleen Oven (mixture of sodium hydroxide and methanol).  A Hazard Communication Training Program was not in place; on or about 03/28/2025.  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
