29 CFR 1926.1101(f)(1)(i): Where exposure monitoring was required under 29 CFR 1926.1101, the employer did not perform monitoring to determine accurately the airborne concentrations of asbestos to which employees were or potentially were exposed:  The employer is failing to protect employees from the health hazards associated with asbestos. This was demonstrated on or about February 17, 2025, and at time prior to at a worksite located at 1180 W 19th Street, Higginsville, MO 64037. The employer did not monitor and determine airborne exposure or potential exposure to employees working with Class II asbestos-containing materials.  The employer Troy Murdock was previously cited for a violation if the occupational safety and health standard or its equivalent standard 29 CFR 1926.1101(f)(1)(i), which was contained in inspection number 1618361, citation number 2, item number 1a and was affirmed as a final order in March 1, 2024, with respect to a workplace located at 12650 Manchester Ave, Grandview, MO 64030.  The employer Troy Murdock was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1101(f)(1)(i), which was contained in OSHA inspection number 1357388, citation number 1,  item number 1a and was affirmed as a final order on July 24, 2020, with respect to a workplace located at 137 Hale Liberty, Manhattan, KS 66506.

29 CFR  1926.1101(f)(3)(i): The employer failed to conduct daily monitoring that was representative of the exposure of each employee assigned to work in regulated areas and performing Class I or II work:  The employer is failing to protect employees from the health hazards associated with asbestos. This was demonstrated on or about February 17, 2025, and at times prior to at a worksite located at 1180 W 19th Street, Higginsville, MO 64037. The employer did not monitor daily the airborne exposure or potential exposure to employees working with Class II asbestos-containing materials.  The employer Troy Murdock was previously cited for a violation if the occupational safety and health standard or its equivalent standard 29 CFR 1926.1101(f)(3)(i), which was contained in inspection number 1618361, citation number 2, item number 1b and was affirmed as a final order in March 1, 2024, with respect to a workplace located at 12650 Manchester Ave, Grandview, MO 64030.  The employer Troy Murdock was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1101(f)(3)(i), which was contained in OSHA inspection number 1357388, citation number 1,  item number 1d and was affirmed as a final order on July 24, 2020, with respect to a workplace located at 137 Hale Liberty, Manhattan, KS 66506.

29 CFR  1926.1101(f)(4)(ii): Where there was a change in process, control equipment, personnel, work practices, or if the employer had any other reason to suspect that a change may have resulted in new or additional exposure above the PELs, the employer failed to institute exposure monitoring required under 29 CFR 1926.1101(f)(3), regardless of whether a "negative exposure assessment" was previously produced for a specific job:  The employer is failing to protect employees from the health hazards associated with asbestos. This was demonstrated on or about February 17, 2025, and at times prior to at a worksite located at 1180 W 19th Street, Higginsville, MO 64037. The employer did not after a change in process initiate airborne exposure monitoring to determine exposure or potential exposure to employees working with Class II asbestos-containing materials.  The employer Troy Murdock was previously cited for a violation if the occupational safety and health standard or its equivalent standard 29 CFR 1926.1101(f)(4)(ii), which was contained in inspection number 1618361, citation number 2, item number 1c and was affirmed as a final order in March 1, 2024, with respect to a workplace located at 12650 Manchester Ave, Grandview, MO 64030. 29 CFR  1926.1101(h)(2)(i):The employer failed to implement a respiratory protection program in accordance with 29 CFR 1910.134(b) through (d) [except (d)(1)(iii)], and (f) through (m), which covers each employee required by 29 CFR 1926.1101 to use a respirator:  The employer is failing to protect employees from the health hazards associated with asbestos. This was demonstrated on or about February 17, 2025, and at time prior to at a worksite located at 1180 W 19th Street, Higginsville, MO 64037. The employer did not implement a respiratory protection program including medical evaluations and fit-testing prior to the use of respiratory protection by employees working with Class II asbestos-containing materials.   The employer Troy Murdock was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1101(h)(2)(i), which was contained in OSHA inspection number 1357388, citation number 1,  item 7a and was affirmed as a final order on July 24, 2020, with respect to a workplace located at 137 Hale Liberty, Manhattan, KS 66506.
