If such hazards are present, or likely to be present: On or about March 25, 2025, at facility located at 550 Maratech Ave. in Marathon City, WI; the employer did not assess the workplace to determine if hazards were present, or were likely to be present, which would necessitate the use of PPE. The employer did not assess splashing liquid hazards before an employee accessed a container of Sunnyside Lacquer Wash when pouring into secondary containers. The employee received eye injuries due to contact with the splashing chemical.

29 CFR 1910.1200(f)(6)(ii): The employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with a product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical: On or about April 3, 2025, at a facility located at 550 Maratech Ave. in Marathon City, WI; the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged, or marked with the hazard warnings of the chemicals within. Flammable liquid dispensing containers of isopropyl alcohol, lacquer thinner (wash), and paint thinner at Coater 4 and Coater 5 were not labeled with the hazards of the chemicals in the respective containers. Some of the containers contained labels which were damaged and illegible; other containers were absent labels of the chemicals' hazards.

29 CFR 1910.1200(h)(3)(iv): Employee training shall include at least the details of the hazard communication program developed by the employer, including an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employees can obtain and use the appropriate hazard information. On or about April 3, 2025, at a facility located at 550 Maratech Ave. in Marathon City, WI; the employee training for hazardous chemicals did not include the workplace labeling system used by the employer. Employees were not provided with training on the workplace labeling system which was similar to the HMIS labeling system when employees worked with hazardous chemicals including but not limited to isopropyl alcohol, lacquer thinner (wash), and paint thinner.
