29 CFR 1910.22(d)(1): Walking-working surfaces are inspected, regularly and as necessary, and maintained in a safe condition; a) On or about March 23, 2025 the employer failed to inspect the arena seating area at the Cintas center, specifically in section 116 to verify that the stairs and/ or guardrail had been replaced after the bleachers were stowed away following an event, to prevent exposing security employees to fall hazards of approximately 6 feet when going to check in and conducting inspections of the facility.

29 CFR 1910.22(d)(2): Hazardous conditions on walking-working surfaces are corrected or repaired before an employee uses the walking-working surface again. If the correction or repair cannot be made immediately, the hazard must be guarded to prevent employees from using the walking-working surface until the hazard is corrected or repaired; and a) On and before March 23, 2025, Best Crown Management Inc., the employer, failed to prevent their employees (security guards) from using the walking-working surface of the Cintas Center arena where guardrails were not installed after the bleachers were retracted on or before March 17, 2025, exposing security guard employees to fall hazards greater than 6 feet.

(i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: (A) Guardrail systems; (B) Safety net systems; or (C) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems. a) On and before March 23, 2025, Best Crowd Management Inc., the employer, failed to ensure that Xavier protected the edge of the spectator seating in section 116 , prior to allowing security employees to utilize this section to gain access to the security office in room 102, exposing employees working in the area to falls of 6 feet or greater to the concrete floor below.

Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart. Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017. a) On or before March 23, 2025, Best Crowd Management, Inc., the employer for security guards working at the Cintas Arena failed to provide training for their employees who were exposed to potential fall hazards in the Cintas Arena, when the bleachers were changed over. As a result, employees were exposed to fall hazards of approximately 6 feet to the concrete floor when the guardrails were removed and not replaced.
