29 CFR 1910.178(m)(1): Trucks shall not be driven up to anyone standing in front of a bench or other fixed object. On or about March 24, 2025, the employer did not ensure that a powered industrial truck was not driven up to an employee who was standing near a fixed object. Employees are tasked with wrapping pallets for shipping and receiving purposes while in the vicinity of moving powered industrial vehicles. The vehicles approach and maneuver toward that employee during the operation.

29 CFR 1910.178(o)(1):The employer did not ensure that only stable or safely arranged loads were handled: On or about March 24, 2025, the employer did not ensure that only stable and secured load were handled within the cold processing area of the facility. Employees "bulldoze" or move multiple pallets in a stacked (horizontal) manner. The pallets were placed in a single row on the forks and not driven in a trailing manner.
