29 CFR  1926.451(g)(4)(xv): Crossbracing used in place of a midrail was unacceptable because the crossing point of two braces is between 20 inches (0.5 m) and 30 inches (0.8 m) above the work platform or as a toprail when the crossing point of two braces is not between 20 inches (0.5 m) and 30 inches (0.8 m) above the work platform or as a toprail when the crossing point of two braces is between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform; and the endpoints at each upright were more than 48 inches (1.3 m) apart:  a) Worksite, stair scaffold, 2nd tier: On or about 4/1/25, employees who were conducting plumbing work were using a stair scaffold to access the roof. The second tier of the scaffold is approximately 12' above the ground and the crossbracing was being used as a toprail as the crossing point of the braces were approximately 38.25" above the work platform. A midrail was not installed on the scaffold and employees were exposed to a fall hazard.   b) Worksite, stair scaffold, 3rd tier: On or about 4/1/25, employees who were conducting plumbing work were using a stair scaffold to access the roof. The third tier of the scaffold is approximately 18' above the ground and the crossbracing was being used as a toprail as the crossing point of the braces were approximately 38.25" above the work platform. A midrail was not installed on the scaffold and employees were exposed to a fall hazard.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system; or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:  a) Worksite, roof: On or about 4/1/2025, employees were conducting plumbing activities on a flat roof, approximately 26 feet above the ground, and were not protected from falls when accessing the roof using a stair scaffold. The roof did not have a guardrail system, personal fall arrest system, or combination with a warning line system when employees access the roof using a stair scaffold.  b) Worksite, stair scaffold: On or about 4/1/2025, employees were accessing a stair scaffold from the roof, approximately 26' above the ground, and were not protected from falls. The roof did not have a guardrail system, personal fall arrest system, or combination with a warning line system when employees access the stair scaffold from the roof.
