Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from crushing hazards:    (a)  On March 20, 2025, at or near 3675 Eighth Street East in Dickinson, North Dakota, employees were exposed to crushing hazards while walking in front of the skid steer to stabilize fire tubes being lifted by a skid steer.  Note: Among other methods, one feasible and acceptable means of abatement to correct the hazard would be to comply with the NIOSH Alert 2011-128 and Bobcat S76 Skid Steer Loader operator's manual, which include, among other requirements, the following: 1)  Keep bystanders away from the work area and travel path, and Other workers should be trained to always keep away from the operators work area and travel path.
