29 CFR 1910.28(b)(2)(ii): The employer did not ensure that when any portion of a guardrail system, gate, or chains is removed, and an employee must lean through or over the edge of the access opening to facilitate hoisting, the employee is protected from falling by a personal fall arrest system. On or about April 3, 2025, on the 3.60 Rotomolding machine operators were exposed to a fall hazard when a portion of the guardrail system was opened to retrieve and remove materials from the Rotoline Mobile Platform. Employees were not provided a personal fall arrest harness and were exposed to serious injury from impact to the lower level.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: On or about April 3, 2025, in the foaming area, the employer did not ensure that employees engaged in Isocyanate foam spraying operations and used a 3M elastomeric full-face respirator were medically able to use that respirator, was cleaned, stored and maintained so that it did not present a health hazard to the user.
