29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: a) 1143 Berryhill Street, Harrisburg, PA 17104: On or about April 3, 2025, employees were exposed to carbon dioxide (CO2) from utilizing dry ice blocks and pellets and the employer had not conducted a reasonable estimate of employee exposure to CO2 in the facility. A CO2 monitor was present in the workplace, however, the reading had exceeded the maximum detection capability of the detector at 5,000 ppm. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated, the person certifying that the evaluation has been performed, the date(s) of the hazard assessment, and, which identifies the document as a certification of hazard assessment: a) 1143 Berryhill Street, Harrisburg, PA 17104: On or about April 3, 2025, the employer maintained a written Dry Ice Use and Handling Job Hazard Analysis and Assessment, however, it did not include the workplace evaluated (company name and site address), the name of the person certifying that the evaluation had been performed, the certification, and the date(s) of the hazard assessment. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
