29 CFR 1910.147(c)(1): The employer had not established a program consisting of an energy control procedure, employee training, and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: 23 S Spencer Rd, Spencer, MA: On and before April 3, 2025, the employer had not established an energy control program to protect employees and outside contractors who performed maintenance and servicing activities on the Dovetail and other multi-energy source machines. *Abatement Notes: Energy control procedures are required to be documented for all multiple-energy source machines. Documented energy control procedures are not required for hardwired single energy source machines such as the band saws, but the employer must ensure they are isolated, locked out, and verified as isolated during blade changes or servicing. Energy control training is required to be documented and provided to ensure that the purpose and function of the energy control program are understood by employees. Employer must ensure that authorized employees acquire the knowledge and skills required for the safe application, usage, and removal of the energy controls to protect themselves and outside contractors. Periodic inspections are required for documented energy control procedures and shall include the following elements: - Appointment of an authorized employee to inspect each local procedure for inaccuracies during an energy control task - A review by inspector with each authorized employee, of that employee's responsibilities under each energy control procedure they are authorized to use - Certification that the periodic inspections have been performed by identifying the machines or equipment on which the energy control procedures were being utilized, the dates of the inspections, the employees included in the inspections, and the persons performing the inspections *Abatement notes are intended only to provide clarity regarding existing requirements under the law or agency policies. Abatement notes do not create (or diminish) legal obligations under the Occupational Safety and Health Act.
