29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer failed to establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures. On or about March 20, 2025, the employer failed to develop and implement a written respiratory protection program for employees required to use respirators including 3M 8511 N95 respirators and various Half Face Respirators when conducting painting, sanding, or grinding operations.

29 CFR 1910.134(e)(1): The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator. On or about March 20, 2025, the employer did not provide a medical evaluation program for employees required to use respirators in the workplace including the 3M 8511 N95 respirators and various Half Face Respirators while performing spray painting operations. Failing to ensure medical evaluations are completed can cause an unidentified medical condition to be exacerbated by the use of a respirator.

29 CFR 1910.134(k): The employer failed to provide effective training to employees who are required to use respirators. The training must be comprehensive, understandable, and recur annually, and more often if necessary. This paragraph also requires the employer to provide the basic information on respirators in Appendix D of this section to employees who wear respirators when not required by this section or by the employer to do so. On or about March 20, 2025, the employer did not conduct respirator training for employees required to use respirators in the workplace, including spray painting operations while working on automobiles. Failure to train employees on the proper use of respirators and the recognition of medical signs and symptoms that may limit or prevent the effective use of respirator, can lead to the exacerbation of underlying medical conditions or dermal contact irritation if used or maintained improperly.

29 CFR 1910.1200(e)(1): Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training would have been met. On or about March 20, 2025, the employer failed to develop and maintain a written Hazard Communication (HAZCOM) program for employees repairing and painting vehicles using spray painting, grinding, sanding, and welding operations. These operations use a mixture of products such as DC2000 Clearcoat Paint and DT895 Paint Reducer which contain hazardous chemicals including but not limited to acetone, butyl acetate, and amyl methyl ketone which can pose hazards such as dermal irritation, headaches, dizziness, and flammability hazards.

Employers did not have a safety data sheet in the workplace for each hazardous chemical they used. On or about March 20, 2025, the employer failed to maintain safety data sheets for employees conducting painting, grinding, sanding, and welding operations to repair vehicles in their shop. Some of the products used in their shop include but are not limited to DC2000 Clearcoat Paint and DT895 Paint Reducer for painting operations, which contain hazardous chemicals including but not limited to acetone, butyl acetate, and amyl methyl ketone, and can pose hazards such as dermal irritation, headaches, dizziness and flammability hazards.
