NOTE: In addition to abatement certification, the employer is required to submit abatement documentation for this item, failure to comply will result in an additional penalty of $1,000.00 as per 29 CFR 1903.19.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1.  Location: 2363 Southern Blvd, Bronx, NY  a) On or about April 03, 2025, employees performing masonry work using Bosch rotary hammers without fully and properly implementing the engineering controls. Employees were cutting into masonry using Bosch rotary hammers that did not a dust collection system as stated in Table 1.  NOTE: Because abatement of this violation is already documented in the case file, the employer need not submit certification nor documentation of abatement of this violation as normally required by 29 CFR 1903.19.
