29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) For the residential construction site at 35105 Brackett Bend, Zephyrhills, FL, on or about 04/02/2025, the employer exposed employees to fall hazards, in that, employees performing framing work were not using any fall protection exposing them to fall hazards of approximately 9 feet and 4 inches.

29 CFR  1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  a) For the residential construction site at 35105 Brackett Bend, Zephyrhills, FL, on or about 04/02/2025, the employer exposed employees to fall hazards, in that, a ladder used by employee to access the upper level/roof of the building only extended approximately 2 feet above the roof/upper level edge.

29 CFR  1926.1053(b)(4):Ladder(s) were used for purposes other than the purpose for which they were designed:  a) For the residential construction site at 35105 Brackett Bend, Zephyrhills, FL, on or about 04/02/2025, the employer exposed employees to fall hazards, in that, employees used an A-frame step ladder with a missing support section as an extension ladder leaning against the roof edge of the building. This is not its intended purpose as designed.

29 CFR  1926.1053(b)(16):Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.  a) For the residential construction site at 35105 Brackett Bend, Zephyrhills, FL, on or about 04/02/2025, the employer exposed employees to fall hazards, in that, an A-frame ladder used by employees to access upper levels/roofs had damaged side rails and a broken free-standing support section. The ladder was still in service.

29 CFR  1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards.   a) For the residential construction site at 35105 Brackett Bend, Zephyrhills, FL, on or about 04/02/2025, the employer exposed employees to fall hazards, in that, employees using ladders had not been trained to recognize hazards related to ladders they were using. Ladders in use had existing damaged sections and were not used for their intended purpose.
