29 CFR  1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  a) On or about 04/08/2025, and thereafter, including 05/19/2025, in the Non-Ferrous Warehouse; Employees were exposed to amputation hazards while operating the Gensco DTX Hydraulic Alligator Shear #1 to cut metal parts, and the foot pedal was not guarded to prevent the inadvertent activation of a run cycle. Lack of guarding creates hazards of unintended operation such as but not limited to, falling or moving objects, operator or other employees walking in the area stepping on the pedal and initiating the machine cycle.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1910.212(a)(3)(ii): Point of operation guards were not designed and constructed as to prevent the operator from having any part of their body in the danger zone during the operating cycle:  a) On or about 04/04/2025, and thereafter, 04/08/2025, and 05/19/2025, in the Non-Ferrous Warehouse; employees were exposed to amputation hazards while cutting metals using the Gensco DTX Hydraulic Alligator Shear #2 without point of operation guarding in place, the guard on the shear was locked in the upright position.  b) On or about 04/04/2025, and thereafter, 04/08/2025, and 05/19/2025, in the Non-Ferrous Warehouse; employees were exposed to amputation hazards while cutting metals using the Gensco DTX Hydraulic Alligator Shear #1 without point of operation guarding in place, the guard on the shear was locked in the upright position. 29 CFR  1904.41(a)(2): Annual electronic submission of OSHA Form 300A Summary of Work-Related Injuries and Illnesses by establishments with 20 or more employees but fewer than 250 employees in designated industries. If your establishment had 20 or more employees but fewer than 250 employees at any time during the previous calendar year, and your establishment is classified in an industry listed in appendix A to subpart E of this part, then you must electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee. You must submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form:  a) On or about 05/08/2025, at Metalico Buffalo, Inc. 127 Fillmore Ave Buffalo, NY 14210; the employer failed during the calendar year 2025, to electronically submit information from their 2024 OSHA Form 300A or equivalent by 03/02/2025.
