29 CFR 1910.252(b)(2)(iii): Workers and other persons adjacent to the welding area were not required to wear appropriate goggles, to protect them from the rays when noncombustible or flameproof screens or shields were not used: a) Welding Station 1, Fabrication Department - On or about April 8, 2025, and at times prior, the employer exposed employees to health hazards associated with arc flash in that welding screens were not used to enclose aluminum and carbon steel welding areas to protect employees welding and other employees in adjacent work areas. b) Welding Station 2, Fabrication Department - On or about April 8, 2025, and at times prior, the employer exposed employees to health hazards associated with arc flash in that welding screens were not used to enclose aluminum and carbon steel welding areas to protect employees welding and other employees in adjacent work areas.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: a) Fabrication and Enclosure Departments - On or about April 8, 2025, and at times prior, the employer failed to ensure that medical clearance was provided to employees enrolled in voluntarily utilizing Miller LPR-100 elastomeric respirators during welding operation.
