29 CFR  1910.134(e)(1):The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.  On or about April 9, 2025, at an establishment located at 2305 San Luis Pl, Green Bay, WI, the employer did not provide a medical evaluation to determine an employee's ability to use a tight-fitting, 3M Model 8511 Particulate Respirator while conducting spray application of Spatterkote and Monokote MK-6 HY.

29 CFR  1910.134(g)(1)(i)(A): The employer shall not permit respirators with tight-fitting facepieces to be worn by employees who have facial hair that comes between the sealing surface of the facepiece and the face or that interferes with valve function.  On and before April 9, 2025, at an establishment located at 2305 San Luis Pl, Green Bay, WI, an employee performing spray applications of Spatterkote and/or Monokote MK-6 HY had a full beard which would have interfered with the sealing surface of the 3M 8511 Particulate Respirator.

29 CFR  1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.  Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (� 1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under � 1926.502(e).  On or about April 9, 2025, at an establishment located at 2305 San Luis Pl, Green Bay, WI, an employee was exposed to fall hazards when the employer did not ensure that the employee working from a Skyjack Model  SJ45T Plus Aerial Lift wore a body belt, or harness, with a lanyard attached to the boom or basket of the lift while conducting fireproofing spray operations.

The training shall include the following areas, as applicable: 1926.454(a)(1)-1926.454(a)(5).
