29 CFR 1926.451(g)(1):Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: KDM Group, LLC at the worksite located at 237 N. Main St. in Lima, OH: On or about April 10, 2025, the employer did not ensure employees were protected from falls while working from a scaffold that was supported by concrete formwork. Guardrails or personal fall arrests systems were not utilized where employees performed work near open sides ; employees were exposed to falling approximately 11' 6" to the ground below. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. KDM Group, LLC at the worksite located at 237 N. Main St. in Lima, OH: On or about April 10, 2025, the employer did not ensure that each employee working from a supported scaffold platform were trained by a qualified person in the recognition of the hazards associated with the type of work platform, and to understand the procedures to control or minimize those hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
