OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish the employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to potential fire, deflagration and explosion hazards associated with combustible metal dust.  a) Production floor: Employees were exposed to fire, and explosion hazards due to the  RAND Bright model 2800 wet dust collection system which was collecting combustible aluminum dust from a metal sanding machine, and located within the building and not grounded and bonded, on or about 4/11/25.   b)Production floor: Employees were exposed to fire, and explosion hazards due to a portable dust collector, DOERR Model LR22132,  which was collecting combustible aluminum dust from a metal sanding machine, and located within the building and not grounded, on or about 4/11/25.   c)Production floor: Employees were exposed to fire and explosion hazards due to the aluminum dust sludge in the  RAND Bright wet dust collection system only being removed every 6 months. On or about 4/11/25.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces were kept in a clean, orderly, and sanitary condition.  a) Production Floor: On or about 4/11/25, an accumulation of explosive metal dust was observed on the surface of equipment, including but not limited to the table saw, and on the production floor exposing employees to fire hazards. Cleaning up this dust with compressed air suspends the explosive dust in the air and exacerbates the fire/explosion hazard.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1910.307(c): Equipment, wiring methods, and installations of equipment in hazardous metal dust processing locations were not intrinsically safe, approved for the hazardous metal dust processing location, or safe for the hazardous metal dust processing location:  (a) Production Floor: On or about 4/11/25, employees were exposed to fire, explosion and deflagration hazards in a Class II Division I location. Combustible metal dust was suspended in the air and could contact  the  electrical equipment not classified for use in a Class II Division I environment, including, but not limited to the Elsele Radial Saw.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.
