This condition exposed employees to flying particles and eye injuries.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) On or about April 11, 2025, the employer, Gamez Brothers Home Improvement LLC, did not ensure the rails of a portable ladder extended at least 3 feet beyond the landing of the residential roof. Employees engaged in residential re-roofing operations on a single story home were using the portable ladder to access the roof. This condition exposed employees to fall hazards of approximately 12 feet.

29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) On or about April 11, 2025, the employer, Gamez Brothers Home Improvement LLC, did not ensure employees were protected from fall hazards of approximately 12 feet while engaged in residential re-roofing operations. During these operations, employees were not utilizing a fall protection system. This condition exposed employees to fall hazards. Gamez Brothers Home Improvement LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(10), which was contained in OSHA inspection number 1704803, citation number 1, item number 1, and was affirmed as a final order on December 18, 2023, with respect to the workplace located at 1410 Barlow Rd, Fort Morgan, CO.
