OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to collision and ejection hazards while operating powered industrial trucks. (a) On or about April 4, 2025, at approximately 3:20 p.m., employees operating a powered industrial truck, Hyster Model S120FT-PRS, Serial #J004V07107U (Clamp Truck #3), were exposed to the hazard of ejection and serious injury due to the failure to use the manufacturer-provided operator restraint (seatbelt). Employees operating powered industrial trucks without the use of the restraint system were at risk of being ejected from the vehicle and striking surrounding structures or the vehicle's protective frame during a collision.
