For each employee engaged in a task identified in Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, the employer did not assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. Location: 5614 Riverdale Ave, Bronx, NY a) On or about April 15, 2025, for employees engaged in a task identified in Table 1, the employer did not fully and properly implement engineering controls for the task specified for the task in Table 1. Employees were exposed to respirable crystalline silica while operating a handheld saw to cut stone without an integrated water delivery system as required. NOTE: Because abatement of this violation is already documented in the case file, the employer need not submit certification nor documentation of abatement of this violation as normally required by 29 CFR 1903.19.
