29 CFR 1926.1153(i)(2)(i): The employer did not ensure that each covered employee could demonstrate knowledge and understanding of at least the information contained in paragraphs (A) - (F) of this section: (a) Gas station parking lot; On or about April 16, 2025, for employees potentially exposed to respirable crystalline silica while engaged in construction tasks involving silica-containing materials, the employer did not ensure all employees received information and training on topics, including but not limited to, sources of respirable crystalline silica, health hazards, and methods to reduce or eliminate exposure.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section: (a) Gas station parking lot; On or about April 16, 2025, a Stihl brand model TS-800 16-inch gasoline-powered cutoff saw was used to cut along concrete/asphalt parking area perimeters without the use of engineering controls to reduce dust clouds and minimize exposures to respirable crystalline silica, specifically, an integrated water-delivery system was not used as required by Table-1, paragraph (c)(1) of this section.
