29 CFR  1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person.  a.  On or about April 22, 2025, located at 420 Cherry Hills Rd, Lot# 244, Commercial Point, Ohio 43116, the employer was not competent in the construction of the pump jack scaffold when the pump jack scaffold system was erected.  The support pole footings were placed on mud sills that were not level on the ground when employees performed siding work off the pump jack scaffold.  The condition exposed employees to fall hazards of approximately 20 feet in the event of the scaffold collapse

29 CFR  1926.452(j)(2): Poles shall be secured to the structure by rigid triangular bracing or equivalent at the bottom, top, and other points as necessary. When the pump jack has to pass bracing already installed, an additional brace shall be installed approximately 4 feet (1.2 m) above the brace to be passed, and shall be left in place until the pump jack has been moved and the original brace reinstalled.   a.  On or about April 22, 2025, located at 420 Cherry Hills Rd, Lot# 244, Commercial Point, Ohio 43116, the employer did not ensure the bottom support poles were secured to prevent the pump jack scaffold footing from becoming displaced.  The support pole footings were placed on mud sills that were not level on the ground when employees performed siding work off the pump jack scaffold.  The condition exposed employees to fall hazards of approximately 20 feet in the event of the scaffold collapse.

29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a.  On or about April 22, 2025, located at 420 Cherry Hills Rd, Lot# 244, Commercial Point, Ohio 43116, the employer failed to ensure that an employee was protected from falls while performing siding work on a steep 6-12 pitch rooftop.  The condition exposed employees to a 14-foot fall hazard as a result.
