29 CFR  1926.416(a)(1): The employer permitted employees to work in close proximity to energized, unguarded, and ungrounded electric power circuits that the employee could contact in the course of their work:   528 Bernardston Rd. ,Greenfield, MA: On or about April 25, 2025, employees were working in close proximity to the live, unguarded electrical service drop wires to the commercial building which was having a roof replacement while still open for business.

29 CFR  1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toe boards, safety net systems, or personal fall arrest systems:  528 Bernardston Rd., Greenfield, MA: On or about April 21, 2025, five employees were observed working on the roof of this commercial building, more than 10 feet above the asphalt/ground below, without any fall protection in use.  Sadi Gonzales, then DBA as Pinguins Construction, LLC, was previously cited for a repeat violation of an equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1687664, citation number 1, item number 1, and was affirmed as a final order on February 20, 2024, with respect to a workplace located at 193 Moody Bridge Rd., Hadley, MA.

29 CFR  1926.1053(b)(1):  When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend the required  3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access:  528 Bernardston Rd., Greenfield, MA: On or about April 25, 2025, the employees were using a multi position aluminum ladder configured as an A-frame ladder to access their roof top work location and the ladder did not extend 3 feet above the upper landing surface.   Sadi Gonzales, then DBA as Pinguins Construction, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1583887, citation number 1, item number 4, and was affirmed as a final order on June 13, 2022, with respect to a workplace located at 260 Longmeadow St., Longmeadow, MA.
