29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) as incorporated by reference under 1926.602(d):  a) 4807 Long Beach Blvd., Beach Haven, NJ: The employer did not ensure that the foreman and workers, who utilized a JLG Skytrak 8042 lift at the worksite, had received training which included formal instruction, hands on and an evaluation with a written certification of completion, on or about 04/24/2025. 29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee use appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors or potentially injurious light radiation:  a) 4807 Long Beach Blvd., Beach Haven, NJ:  Two workers were exposed to struck by hazards when using electric, portable circular saws and nail guns  without eye or face protection while cutting plywood, wooden framing components, nailing framing and plywood, and other related materials used in the framing and sheathing activities at the worksite. Condition observed on or about 04/24/2025.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the unsecured plywood was not secured to the forks and the forklift was left unattended while the stacked plywood platform was occupied:  a) 4807 Long Beach Blvd., Beach Haven, NJ: Employee engaged in framing installation and other related activities was exposed to fall hazards, roughly 20 feet to the ground surface below, when standing on unsecured plywood that was raised in the air by a JLG Skytrak 8042 near the second-floor level area on the side of a residential structure without the use of fall protection. Condition noted on or about 04/24/2025.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. Condition noted on or about 04/24/2025.  b)  4807 Long Beach Blvd., Beach Haven, NJ: Employees engaged in framing installation and other related activities were exposed to fall hazards, roughly 20 feet to the ground surface below, when working near unprotected edges of the second-floor level window of a residential structure without the use of fall protection. Employee was sitting on a window frame and had one leg on the outside on the roof. Condition noted on or about 04/24/2025.  AAR Riberio Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1703180, citation number 1, item number 1 and was affirmed as a final order on 12/28/2023, with respect to a workplace located at 2600 Long Beach Blvd, Long Beach, NJ.  AAR Riberio Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1710658, citation number 1, item number 1 and was affirmed as a final order on 01/30/2024, with respect to a workplace located at 9212 Beach Avenue, Long Beach, NJ.  AAR Riberio Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1740194, citation number 1, item number 4 and was affirmed as a final order on 07/11/2024, with respect to a workplace located at 26 Anderson Drive, Long Beach, NJ.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
