29 CFR 1910.29(b)(2): The employer did not ensure that guardrail systems met the requirement that midrails, screens, mesh, intermediate vertical members, solid panels, or equivalent intermediate members that are installed between the walking-working surface and the top edge of the guardrail system as follows when there is not a wall or parapet that is at least 21 inches (53 cm) high: On or about January 24, 2025, April 17, 2024 and April 24, 2025, employees were exposed to fall hazards of 10 feet from the work platform at Loadout #1 (Pit #2 Loadout) and Loadout #2 (Blue Building Loadout) due to missing midrails on both work platforms, at the Westfield, Illinois, facility.

29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): On or about April 17, 2025, an employee was exposed to fall hazards of 10 feet from the work platform at Loadout #2 (Blue Building Loadout), without fall protection from the work platform on the side adjacent to the truck being loaded, at the Westfield, Illinois, facility. EFFINGHAM EQUITY WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1910.28(b)(1)(i), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1556032, CITATION NUMBER 1, ITEM NUMBER 1 AND WAS AFFIRMED AS A FINAL ORDER ON DECEMBER 23, 2021, WITH RESPECT TO A WORKPLACE LOCATED AT 13991 E. 1700TH ROAD, CHRISMAN, ILLINOIS 61924.
