29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. On or about April 25, 2025, the employer did not ensure the point of operation on drag and screw conveyors was guarded to prevent employees from having any part of their body in the danger zone during operations while opening inspection doors and/or lids. Employees were exposed to caught-in hazards from the conveyors rotating parts which could result in crushing injuries and amputations. The following instances were observed and/or documented: (a) CS-7107: There was no guarding present at the conveyor discharge lid. (b) CS-7109: There was no guarding present at the conveyor discharge lid. (c) CS-7207: There was no guarding present at the conveyor discharge lid. (d) CS-7209: There was no guarding present at the conveyor discharge lid. (e) CD-6601: There was no guarding present at the head door. (f) CS-7407: There was no guarding present on the lower-level at the conveyor discharge lid. (g) CS-6707: There was no guarding present at the conveyor discharge lid. (h) CD-6701: There was no guarding present at the head door. (i) CD-1303: There was no guarding present at the head, and the inspection door was not secured (j)CD 1308: There was no guarding present at the head, and the inspection door was not secured

29 CFR 1910.30(c) (c) Retraining. The employer must retrain an employee when the employer has reason to believe the employee does not have the understanding and skill required by paragraphs (a) and (b) of this section. Situations requiring retraining include, but are not limited to, the following: On or about April 25, 2025, the employer did not ensure that employees working in the hoist areas in Energy Center 1 and Energy Center 2 were protected from falling to the lower level. Employees were exposed to falls of greater than 10 feet which could result in broken bones, head injury, permanent disability, or death. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.212(a)(2): General requirements for machine guards. Guards shall be affixed to the machine where possible and secured elsewhere if for any reason attachment to the machine is not possible. The guard shall be such that it does not offer an accident hazard in itself. On or about April 25, 2025, the employer did not ensure all the covers (lids) for the Flottweg Decanters (Centrifuges) were secured per the manufacturer's operating instructions. Centrifuges 5, 6, and 7 did not have the lids bolted in place while operating. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
