29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: The employer did not instruct employees in the recognition and avoidance of unsafe working conditions caused by moving machinery, in the following instances: a) Worksite - On or about December 6, 2024, an employee suffered a concussion from striking their head and falling, due to walking in close proximity to a moving excavator. b) Worksite - On or about April 23, 2025, an employee suffered a lower leg amputation after walking between a moving excavator and the load being lifted.
