29 CFR 1910.147(c)(7)(i): The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following: (A) A specific statement of the intended use of the procedure; (B) Specific procedural steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy; (C) Specific procedural steps for the placement, removal and transfer of lockout devices or tagout devices and the responsibility for them; and (D) Specific requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control measures. On or about April 17, 2025, at an establishment located at W4315 County Road JM in Sheboygan Falls, Wisconsin, on the RP1 Line; employees were required to perform servicing and maintenance tasks on the flash steam machine such as, but not limited to, threading film through the head. The procedures did not clearly and specifically outline the specific procedural steps for shutting down and isolating the machine, nor did the procedure identify specific procedural requirements for testing the machine to verify the effectiveness of lockout devices on energy sources such as, but not limited to, steam, pneumatic, and electrical energies to be isolated for the control of hazardous energy, and the means to enforce compliance.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): (d)(1) Preparation for shutdown; (d)(2) Machine or equipment shutdown; (d)(3) Machine or equipment isolation; (d)(4) Lockout or tagout device application; (d)(5) Stored energy release; and, (d)(6) Verification of isolation. On or about April 17, 2025, at an establishment located at W4315 County Road JM in Sheboygan Falls, Wisconsin, on the RP1 Line; the employer did not ensure that all the steps outlined in 29 CFR 1910.147(d), required for the control of hazardous energy sources, were performed prior to employees conducting servicing and maintenance tasks at the head of the flash steam machine on the discharge end. Employees were exposed to crushed-by, amputation, and burn hazards associated with moving machine parts and steam when they reached under the fixed guard to retrieve the end of the the film that broke off at the head. The flash was not deenergized prior to employees engaging in servicing and/or maintenance activities, exposing employees to amputation and burn hazards from the steam hood. As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine hazards.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. On or about April 28, 2025, at an establishment located at W4315 County Road JM in Sheboygan Falls, Wisconsin, on the RP1 Line: a) The employer did not ensure that adequate guarding was provided on the backside of the loader head to prevent employees from reaching into the machine with their hands and arms, exposing them to the sheer points and caught-between hazards created by the gliding loader head mechanisms and the fixed components of the assembly. b) The employer did not ensure that adequate guarding was provided on the downstream side of the loader head to prevent the hands of employees from reaching between the loader head and tray conveyor, exposing them to the caught-between hazard created by the loader head mechanism and the tray conveyor.
