29 CFR 1926.1153(c)(1):For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. (a) 1000 St. Georges Ave Avenel, NJ 07001 - Employee(s) including operator(s) of hand-held power saw and other laborer(s) working on masonry wall were exposed to the hazard of crystalline silica inhalation due to the employer's failure to implement effective engineering controls prescribed in Table-1 for control of dust. Employee(s) used a STIHL portable power saw to cut concrete block(s) without integrated water delivery system for continuously feeding water to the blade, as designed for use with the tool for dust suppression. Conditions noted on or about 03/05/2025.

29 CFR 1926.1153(d)(2)(i):The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section: (a) 1000 St. Georges Ave Avenel, NJ 07001 -Employee(s) including operator(s) of hand-held power saw and other laborer(s) working on masonry wall were exposed to the hazard of crystalline silica inhalation due to lack of the employer's failure to implement engineering controls prescribed in Table-1 for control of dust. Employee(s) used a Stihl TS 420 portable saw without an effective integrated water delivery system for continuously feeding water to the blade while cutting masonry blocks. Where the control measures prescribed in Table-1 were not implemented, the employer did not assess employees' exposure to crystalline silica through air monitoring. Conditions noted on or about 03/05/2025.
