29 CFR  1926.20(b)(1):The employer did not initiate and maintain an accident prevention program as may be necessary to comply with this part.  a)  Jobsite located at or near 6611 Lincoln Drive. Philadelphia, PA - On or about April 28, 2025,  the employer allows employees to work on jobsites without initiating an accident prevention program to address the hazards that employees are exposed to during roofing activities, such as but not limited to fall hazards.  Employees were observed working on a roof without the use of fall protection and using a ladder that was not 3 feet above the working surface.  The employees were  exposed to fall hazards of approximately 30 feet in height to the ground level below without an accident prevention program.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  Jobsite located at or near 6611 Lincoln Drive. Philadelphia, PA - On or about April 28, 2025, the employer did not ensure employees performing residential roofing were protected from falls by guardrail systems, safety net system, or personal fall arrest system. The employees were working from the roof of an third-story building without the use of fall protection, thereby exposing employees to fall hazards.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) Jobsite located at or near 6611 Lincoln Drive. Philadelphia, PA - On or about April 28, 2025, the employer did not provide effective training to employees who was exposed to fall hazards during residential construction activities.  Employees were performing roofing activities without fall protection training, thereby exposing employees to falls of approximately 30 feet.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Jobsite located at or near 6611 Lincoln Drive Philadelphia, PA - On or about April 28, 2025,On or about April 28, 2025, the employer did not ensure that the side rails of a portable ladder used for access to an upper landing surface extended at least 3 feet above the upper landing surface being accessed. Employees utilized a portable ladder to access a third-story roof without having the side rails extended at least 3 feet above the landing surface, thereby exposing employees to fall hazards.
