29 CFR 1910.132(a): Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.   On or about April 29, 2025, at the establishment located at 445 Cardinal Lane Green Bay, Wisconsin; the employer did not provide employees with protective gloves and eye protection while working with cleaning chemicals, exposing employees to irritation of the skin and eyes.

29 CFR  1910.133(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about April 29, 2025, at the establishment located at 445 Cardinal Lane Green Bay, Wisconsin; the employer did not ensure that employees used appropriate eye protection when using Subway Multi-Surface & Glass Cleaner daily to clean surfaces in the restaurant daily.

29 CFR  1910.1200(g)(8): The employer shall maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and shall ensure that they are readily accessible during each work shift to employees when they are in their work area(s). (Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.):  On or about April 29, 2025, at the establishment located at 445 Cardinal Lane Green Bay, Wisconsin; the employer did not maintain safety data sheets for each hazardous chemical in the facility. The employer did not have Safety Data Sheets (SDSs) available for employees to access information such as potential acute health effects, exposure controls, and personal protection methods.
