The interior surfaces of spray booths shall be smooth and continuous without edges and otherwise designed to prevent pocketing of residues and facilitate cleaning and washing without injury. (Reference 29 CFR 1910.94(c)(3)(i)): On or about April 28, 2025, at the establishment located at 2049 Creamery Road, De Pere, Wisconsin, the interior surfaces of the spray booth were not smooth and continuous. Portable light fixtures, conduit, and multiple electrical junction boxes allowed residue to accumulate on the surfaces.

29 CFR 1910.107(c)(5): Unless specifically approved for locations containing both deposits of readily ignitable residue and explosive vapors, there shall be no electrical equipment in any spraying area, whereon deposits of combustible residues may readily accumulate, except wiring in rigid conduit or in boxes or fittings containing no taps, splices, or terminal connections: On or about April 28, 2025, at the establishment located at 2049 Creamery Road, De Pere, Wisconsin; a. Electrical equipment, such as but not limited to junction boxes, portable electrical lights, and extension cords in the spray booth were exposed to deposits of readily ignitable residue and were not specifically approved for that location. b. An electric SkyJack SJIII 3219 aerial platform used to access the top of box trailers during the spray finishing operations in the spray booth was exposed to deposits of readily ignitable residue and was not specifically approved for that location.

29 CFR 1910.107(c)(8): Portable lamps. Portable electric lamps shall not be used in any spraying area during spraying operations. Portable electric lamps, if used during cleaning or repairing operations, shall be of the type approved for hazardous Class I locations. On or about April 28, 2025, at the establishment located at 2049 Creamery Road, De Pere, Wisconsin, portable electric lamps were used to illuminate Bay 20 during spray operations exposing employees to fire hazards.

29 CFR 1910.107(g)(2): All spraying areas shall be kept as free from the accumulation of deposits of combustible residues as practical, with cleaning conducted daily if necessary. Scrapers, spuds, or other such tools used for cleaning purposes shall be of nonsparking material: On or about April 28, 2025, at the establishment located at 2049 Creamery Road, De Pere, Wisconsin, the employer did not ensure that the spray booth in Bay 20 was as free as practical from the accumulation of deposits of combustible residues. Overspray from spray finishing operations had been allowed to accumulate on the interior walls and floor of the spray booth.

29 CFR 1910.23(b)(10): 29 CFR 1910.23(b)(10): The employer did not ensure that any ladder with structural or other defects as immediately tagged "Dangerous: Do Not Use" or with similar language in accordance with � 1910.145 and removed from service until repaired in accordance with � 1910.22(d), or replaced. On or about April 28, 2025, at the establishment located at 2049 Creamery Road, De Pere, Wisconsin, the employer did not ensure that ladders were removed from service and repaired when covered in paint overspray. Employees utilized one 8-foot and three 12-foot A-Frame ladders to conduct spray painting operations in Bay 20 of Building 2 and did not inspect the ladders before use. The ladders were covered in overspray and could not be inspected for visible defects in the frame.
