29 CFR 1926.1153(c)(1):For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. (a) On or about April 29, 2025, an employee was dry cutting concrete with a handheld power saw (STIHL TS 420) without an integrated water delivery system, exposing the employee to respirable crystalline silica.

29 CFR 1926.1153(d)(2)(ii):The employer did not assess the 8-hour TWA exposure for each employee on the basis of any combination of air monitoring data or objective data sufficient to accurately characterize employee exposures to respirable crystalline silica: (a) On or about April 29, 2025, the employer had not completed an assessment for silica to determine employee exposure when engineering controls, required by Table 1, for the handheld power saw were not fully implemented, exposing the employee to respirable crystalline silica.

29 CFR 1926.1153(i)(2)(i):The employer did not ensure that employees covered by this section could demonstrate knowledge and understanding of at least the requirements outlined in 29 CFR 1926(i)(2)(i)(A) through (F) where there was exposure to respirable crystalline silica: (a) On or about April 29, 2025, the employer did not provide employees with training on silica that includes information such as, health hazards, tasks that create exposure, controls to mitigate exposure, and medical surveillance.
