(a) Bayron Alexander Garcia failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:  Citation 1, Item 1, a serious violation of 29 CFR 1926.501(b)(13) with an abatement date of October 24, 2025.    Citation 1, Item 2 a serious violation of 29 CFR 1926.1053(b)(1) with an abatement date of October 9, 2025.

29 CFR  1926.300(b)(2): Moving part(s) of equipment exposed to contact by employees or which otherwise created a hazard, were not guarded:  (a)  On or about April 28, 2025 at 1028 Arrowwood Ct, Pewaukee, WI, an employee used an TranzSporter Platform Hoist TP250  ladder to convey materials up to the roof. The hoist did not have the power transmission pulley and belt guarded, exposing employees to a caught-in hazard and amputation hazard.

Exposing the employees to a fall hazard of approximately 10 feet onto the concrete.

29 CFR  1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:  (a) On or about April 28, 2025 at 1028 Arrowwood Ct, Pewaukee, WI, the employer failed to ensure that the TranzSporter Platform Hoist TP250, 13-foot hoist ladder was used for the purpose it was designed. Employee working from the roof of a residential home improperly utilized the 13-foot hoist ladder as a personal ladder. This practice exposed employees to a tip-over and fall hazard from the ladder to the ground below.
