29 CFR 1910.212(a)(3)(ii):Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s): (a)Dakota Butcher - Clark, Inc. at 99 South Commercial Street, Clark, SD 57225: On or about and at times prior to April 30, 2025, the employer did not ensure that the Biro Band Saw was effectively guarded in that, the height of of the guard was not adjusted down to the height of the meat to prevent the operator from reaching the point of operation. This condition exposed employees to struck by and amputation hazards.

29 CFR 1910.138(a): The employer did not select and require employee(s) to use appropriate hand protection when employees' hands were exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasion: (a)Dakota Butcher - Clark, Inc. at 99 South Commercial Street, Clark, SD 57225: On or about and at times prior to April 30, 2025, the employer did not ensure that employees cutting meat were protected from severe cuts or laceration hazards in that there was no requirement for personal protective equipment involving employees hands. This condition exposed employees to struck by, laceration and amputation hazards.
