29 CFR  1926.451(b)(1)(ii): The platform was not planked or decked as fully as possible and the remaining open space between the platform and the uprights exceeded 9.5 inches (24.1 cm).  a) Worksite located at 125 Academy St, Belleville, NJ; 10-tier scaffold  On or about 4/28/2025, employees were exposed to fall hazards of approximately 60 feet from the top of the 10-tier scaffold to the ground below while performing masonry work. Employees stood on the the working platform, which was not fully planked or decked.

29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) Worksite located at 125 Academy St, Belleville, NJ; ground level  On or about 4/28/2025, employees were exposed to dust containing crystalline silica which was liberated when a handheld power saw was used to cut concrete blocks at the worksite. The employer failed to assess worker exposure to airborne crystalline silica to include implementing engineering controls (wet methods and shroud/dust collection system) during masonry activities.
