OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards from automotive lifts: A) Patriot Motors Seneca LLC. dba Northpointe Automotive on or about April 14, 2025 and times prior thereto: employees were potentially exposed to struck-by hazards while using Lift #2. Lift #2 had deficiencies that included, but were not limited to, leaking hydraulic cylinders. The Auto Lift #2 had not received an annual inspection since calendar year 2020. B.) Patriot Motors Seneca LLC. dba Northpointe Automotive on or about April 14, 2025 and times prior thereto: employees were potentially exposed to struck-by hazards while using Lift #2. Lift #2 had deficiencies that included, but were not limited to, leaking hydraulic cylinders. Daily inspections of Auto Lift #2 were not completed.

The Auto Lift was not tagged out of service and/or rendered inoperative through lockout/tagout.
