OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees,  in that employees were exposed to struck-by hazards from automotive lifts:  A) Patriot Motors Seneca LLC. dba Northpointe Automotive on or about April 14, 2025 and times prior thereto: employees were potentially exposed to struck-by hazards while using Lift #2.  Lift #2 had deficiencies that included, but were not limited to, leaking hydraulic cylinders.  The Auto Lift #2 had not received an annual inspection since calendar year 2020.  B.) Patriot Motors Seneca LLC. dba Northpointe Automotive on or about April 14, 2025 and times prior thereto: employees were potentially exposed to struck-by hazards while using Lift #2.  Lift #2 had deficiencies that included, but were not limited to, leaking hydraulic cylinders.  Daily inspections of Auto Lift #2 were not completed.

29 CFR  1910.145(f)(3): Tags were not used as a means to prevent accidental injury or illness to employees who were exposed to hazardous or potentially hazardous conditions, equipment or operations which were out of the ordinary, unexpected or not readily  A) Patriot Motors Seneca LLC. dba Northpointe Automotive on or about April 14, 2025 and times prior thereto: The Hydraulic cylinder was leaking on the Auto Lift (lift 2), parts were ordered but the lift was still in need of service.  The Auto Lift was not tagged out of service and/or rendered inoperative through lockout/tagout.

29 CFR  1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical  A) Patriot Motors Seneca LLC. dba Northpointe Automotive on or about April 29, 2025 and times prior thereto: Employees were using brake cleaner in a Sure Shot Milwaukee sprayer without labeling the can with the contents and the hazard warnings of the substance contained inside.
