29 CFR 1910.23(c)(4): The employer did not ensure that ladders that are used only on stable and level surfaces unless they are secured or stabilized to prevent accidental displacement: (a) In front of the main building at the site, located at 5000 Culbreath Key Way, Tampa, FL, 33611, on or about 4/23/2025: the employer exposed employees to fall and struck by hazards, in that employees were using an approximately six foot tall A frame ladder set up on a sloped surface while trimming bushes with a SHC-2620/S Shaft Hedge Trimmer.

29 CFR 1910.132(d)(1):The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment: (a) In front of the main building at the site, located at 5000 Culbreath Key Way, Tampa, FL, 33611, on or about 4/23/2025: the employer exposed employees to struck by hazards, as employees utilized equipment such as SHC-2620/S Shaft Hedge Trimmers without any hazard assessment being performed to determine what hazards were present and if personal protective equipment was needed.
