29 CFR  1926.1153(c)(1):For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:  a.) On or about May 2, 2025, and at times prior, employees were exposed to silica inhalation hazards while grinding on a stone slab outside. The employee was using a hand-held grinder that was not equipped with either an integrated water delivery system or a commercially available shroud and dust collection system, per the engineering and work practice controls specified in Table 1. The employer failed to ensure employees were following Table 1 while shaving off additional slab material using the hand grinder. There was visible dust during the cutting. 29 CFR  1926.1153(d)(1): The employer did not ensure that employees were not exposed to an airborne concentration of respirable crystalline silica in excess of 50 ug/m3, calculated as an 8-hour TWA:  a.) On or about May 2, 2025, and at times prior, the employer did not ensure that employees conducting grinding operations on a stone slab were not exposed to respirable crystalline silica in excess of 50 ug/m3.  Abatement Note: Abatement certification and documentation are required for this item (see enclosed Certification of Corrective Action Worksheet).
