29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  On or about May 6, 2025, employees performing roofing activities were exposed to fall hazards and the employer did not ensure the job site was inspected by a competent person able to identify the hazard and take immediate action to correct or eliminate the hazard.  a. Employees were allowed to jump into the Equipter drivable dumpster from the roof and the competent person did not recognize the fall hazards and prohibit the activity.  b. Employees who were assigned the task of fall protection monitor performed other roofing activities while on the roof and the competent person did not inspect the site for the hazard and prohibit the monitor from performing other work.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:  On or about May 6, 2025, employees performing roofing activities were exposed to fall hazards of approximately 12 feet and the employer did not ensure fall protection was being used.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about May 6, 2025, employees performing roofing activities were exposed to approximately 10-foot fall hazards when jumping onto a raised Equipter drivable dumpster and the employer did not ensure fall protection was being used.  a. An employee was walking on the flat closed lid of the raised Equipter dumpster and fall protection was not used.  b. An employee was working inside the raised Equipter dumpster and fall protection was not used.
