1926.502(a)(2) The employer did not provide and install all fall protection systems required by this subpart for employee(s) and did not comply with all other pertinent requirements of this subpart before employee(s) began the work that necessitates the fall protection. a) Lot 96, Worksite, Second Floor - on or about May 8, 2025, employees performing frame carpentry work were exposed to a fall of approximately nine feet, nine inches above the lower level without utilizing any means of fall protection. b) Lot 96, Worksite, Second Floor - on or about May 8, 2025, employees performing frame carpentry work were exposed to a fall of approximately nine feet, nine inches above the lower level due to the installed guardrail's top-rail height of 35 inches above the walking / working surface. c) Lot 96, Worksite, Porch Roof - on or about May 8, 2025, employees performing frame carpentry work were exposed to a fall of approximately nine feet, 11 inches above the lower level without utilizing any means of fall protection. No abatement certification or documentation required.

29 CFR 1926.602(c)(1)(viii)(A): The industrial truck was not equipped with a safety platform/cage firmly secured to the lifting carriage and/or forks when used for lifting personnel: a) Lot 96, Worksite - on or about May 8, 2025, employees were utilizing a Pettibone 8044 Variable Reach Rough Terrain Forklift to lift a supported scaffold to the working height, but the scaffold was not secured to the carriage or forks while it was in use. No abatement certification or documentation required.
