29 CFR 1926.453(b)(2)(v):A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated On or about May 8, 2025, an employee was engaged in carpentry activities from a Nifty SP34 aerial lift on a residential building and was exposed to fall hazards as he was not utilizing fall protection. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.454(a)(1): The employer failed to have each employee who performs work while on a scaffold trained regarding the nature of any electrical hazards, fall hazards and falling object hazards in the work area. On or about May 8, 2025, the employer did not ensure that employees had been trained to recognize and minimize fall hazards. Employees were engaged in carpentry activities from a Nifty SP34 aerial lift on a residential building were exposed to fall hazards in approximately 10 feet when they were not utilizing fall protection. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
