The assembly shifted when the foreman stepped on it, causing him to fall approximately 16 feet to the ground and sustain serious injuries.

29 CFR  1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section.  a) On or about May 7, 2025, the employer failed to ensure the Hydromobile scaffold system was constructed in accordance with the manufacturer's design specifications. Specifically, a bearing bridge platform was assembled at a 90-degree inside corner using only one outrigger instead of the required two outriggers, as specified in the manufacturer's manual. The planks were secured to the outrigger with screws without using the required tube and clamp arrangement or additional support components such as knuckles. When an employee stepped onto the platform, the assembly shifted, resulting in a fall of approximately 16 feet.
