29 CFR 1926.300(b)(2): Belts, gears, shafts, pulleys, sprockets, spindles, drums, fly wheels, chains, or other reciprocating, rotating or moving parts of equipment shall be guarded if such parts are exposed to contact by employees or otherwise create a hazard. Guarding shall meet the requirements as set forth in American National Standards Institute, B15.1-1953 (R1958), Safety Code for Mechanical Power-Transmission Apparatus. a) On or about May 9, 2025, at the worksite located at Highway 441 by Exit 289A, Menasha, Wisconsin; the employer did not ensure that the drive belts on a walk-behind saw (Manufacturer: Diamond Products, Model: CC6571D, Equipment Identifier: 155779) were adequately guarded, exposing an employee to caught-in hazards.

29 CFR 1926.1153(c)(2)(ii): For tasks performed using wet methods, apply water at flow rates sufficient to minimize release of visible dust. On or about May 9, 2025, at the worksite located at Highway 441 by Exit 289A, Menasha, Wisconsin; the employer did not ensure that water was applied at flow rates sufficient to minimize the release of visible dust, exposing employees to the hazards associated with respirable crystalline silica in the following instances: a) An employee operating a walk-behind saw (Manufacturer: Diamond Products, Model: CC6571D, Equipment Identifier: 155779) to cut concrete generated visible dust clouds when used with an integrated water delivery system. The employee was exposed to a time-weighted average (TWA) of 94.0 ?g/m3 of respirable crystalline silica, approximately 1.88 times the permissible exposure limit (PEL) of 50 ?g/m3. The exposure level was derived from one sample collected over a 124-minute sampling period. b) An employee operating a walk-behind saw (Manufacturer: Diamond Products, Model: CC6571D, Equipment Identifier: 145945) to cut concrete generated visible dust clouds when used with an integrated water delivery system. The employee was exposed to a TWA of 89.5 ?g/m3 of respirable crystalline silica, approximately 1.79 times the PEL of 50 ?g/m3. The exposure level was derived from one sample collected over a 125-minute sampling period.
